Privacy:
Nyx Grafix does not sell, duplicate or refer your e-mail address, phone number or any other information to any other company for any reason, unless requested by you.

Copyright and Trademarks:
The client unconditionally guarantees that any elements of text, graphics, photos, designs, trademarks, or other artwork provided to Nyx Grafix for inclusion in the web design project are owned by the client, or that the client has gained permission from the rightful owner to use each of these elements, and will hold harmless, protect and defend Nyx Grafix from any claim or suit arising from the use of such elements furnished by the client.

Rights Agreement:
Upon completion and full payment all the rights of the web site design and graphics that Nyx Grafix. has created and designed for the specific client transfers to the client for which it was designed with the understanding that no core images may be altered, sliced, cropped or credited to another designer. In the event that payment for any web design service is not made in accordance with the payment policies of Nyx Grafix, or above term is violated, then all of client's rights in and to the web design created for it, including any trademark property, will immediately revert back to Nyx Grafix.

Nyx Grafix retains the right to display ALL work as samples and in a portfolio whether or not it was used by the client.

Payment and Fees:
A deposit of 50% of the total estimated project shall be remitted upon signing our contract or requesting work. In addition, Nyx Grafix  hourly rate and project expenses minus the 50% deposit shall be billed at project completion. Expenses may include, but are not limited to, telephone, travel, stock images, design and graphic services, and programming.

All payments will be made in U.S. funds. Payment is accepted by check, money order or via Paypal. If paying by check, you agree that should your bank return your check for any reason, you will be liable for any additional fees incurred by Nyx Grafix You further agree that should your bank return your check(s), for any reason, Nyx Grafix will charge you a $50.00 fee and you will be responsible for payment in full upon notification by your bank, and/or Nyx Grafix

Invoices must be paid with 15 days of reciept. After 15 days Nyx Grafix reserves the right to add an additonal 15% to the outstanding balance.
